Terms of Service

Version terms-2026-10-25 · last updated 25 October 2026

1. About these terms

These terms apply to the Resthe product and service you obtain through resthe.com (“Resthe”, “we”, “us”). Resthe is operated by MTIRA LLC; see “Operator” at the end.

For transactions processed through Stripe Managed Payments, Stripe provides the checkout and, under the Sold through Link program, acts as merchant of record for the payment transaction. Stripe/Link’s purchase and payment terms also apply. If there is a conflict about payment processing, refunds handled by Stripe, taxes collected at checkout, or other matters Stripe controls as merchant of record, the applicable Stripe/Link terms control to the extent required by those terms or by law.

By placing an order you accept the version of these Resthe terms shown or linked at checkout. Nothing in these terms limits rights you have as a consumer that cannot lawfully be waived.

To place an order you must be at least 18 years old, or the age of majority where you live if that is higher.

2. What you buy

A Resthe gift is a commemorative dedication of a real natural or astronomical moment at a point on Earth, to a person you name. It is recorded in the private Resthe registry and comes with a gift page and a digital certificate.

  • It is not ownership of the sky, the sun, the moon, the weather, land or any place.
  • It is not an official government, scientific or property registration and has no legal effect toward third parties.
  • It is not exclusive: the same type of moment at the same place may be dedicated by other people.
  • It is not an investment, security or financial product and cannot be resold or transferred through Resthe.

The short line on a certificate (“A commemorative dedication, not ownership or an official registration.”) refers to this section in full.

3. How moments are confirmed

Each product has a formal rule with a version number. The version in force when you pay is stored with your order, and later changes do not alter gifts already sold.

  • Sunrise and sunset are calculated using the NOAA solar algorithm for the upper edge of the sun with standard refraction (0.833°). You get the nearest qualifying event strictly after payment, or the event on the day you choose, up to two years ahead.
  • Full moon night is the local night (sunset to sunrise) whose middle is closest to the astronomical moment of full moon, calculated using the applicable Resthe rule; you get the nearest qualifying night whose sunset occurs after payment, or the first such night from the day you choose, up to two years ahead.
  • Life Moments are calculated from a date you enter (a birth, a meeting, a wedding or an engagement) and the place you choose, using the same sunrise and full moon rules. The moment itself is always one still ahead, strictly after payment: Your First Sunrise is the first sunrise after the birth; Our First Full Moon Night is the first full moon night on or after the date; Anniversary Sunrise is the sunrise on the next anniversary (29 February anniversaries use 28 February in common years); Our Sunrises Together is the sunrise on the date you choose (the next sunrise unless you choose another date), numbered from the first sunrise after the meeting (sunrises are counted exactly, so polar nights and polar days are not counted). Local dates and times are converted with the historical time-zone rules of the place. The moment must be at least 15 minutes after the order and no more than two years after it. If the moment you entered has already happened, or is too close, it is not offered; if a payment is confirmed only after the moment, we refund it in full automatically. A date in the future (for example an expected birth) is your choice, and the moment is calculated from the date and time you entered.

Astronomical moments are calculated, not visually observed. Calculated times are intended to be accurate to about one minute, but local visual conditions can differ. A moment takes place for Resthe purposes whether or not it can be seen. Clouds, weather, terrain, buildings, haze or light pollution do not change the calculated astronomical event and, by themselves, are not grounds for a refund.

We do not intentionally sell a moment that our rules show will not occur within the applicable product window at the chosen point (for example, during polar day or polar night). Where the site detects that condition, it is shown before payment.

4. Future moments, dedication length and late payment

  • Only future moments. Every Resthe moment is still ahead when you order. A moment that has already happened is never sold. For Sky Wonders products, the moment is the nearest qualifying event strictly after payment, or the one on the day you choose, no more than two years ahead. For Life Moments, the moment must be at least 15 minutes after the order and no more than two years after it.
  • Dedication length. A dedication message can be up to 240 characters for Sky Wonders products (The Sunrise, The Sunset, The Full Moon Night) and up to 140 characters for Life Moments (Your First Sunrise, Our First Full Moon Night, Anniversary Sunrise, Our Sunrises Together). A Chinese, Japanese or Korean character (Han, kana or Hangul) counts as two, so such a text can be up to 120 or 70 of these characters and stays large enough to read on the certificate.
  • Late payment. If a payment is confirmed only after the moment it was for has already happened (for example, a payment method that confirms with a delay), the order is not fulfilled and the full amount is refunded automatically; we email you when this happens. For Sky Wonders products, the nearest moment is calculated from the time of payment; a moment on a day you chose follows the same late-payment rule.

5. Place, coordinates and local time

You confirm the point on the map before paying. After payment, the coordinates for that order cannot be changed. Times are shown in the local time zone assigned to the selected coordinates.

Place names are descriptive labels derived from mapping data and may not exactly match postal or administrative boundaries. The coordinates stored with the order control the Resthe location.

6. Prices, payment and taxes

Prices and any applicable taxes are shown at or before checkout.

For orders processed through Stripe Managed Payments / Sold through Link, Stripe acts as merchant of record for the transaction. Stripe calculates, collects, files and remits applicable indirect transaction taxes that it is responsible for under the Managed Payments program, such as sales tax, VAT or GST in supported jurisdictions.

  • Checkout, the payment receipt and transaction-level payment support are provided through Stripe/Link.
  • Your card or bank statement may show LINK.COM* RESTHE or a substantially similar descriptor.
  • Resthe does not receive or store your full card number or CVC.
  • Stripe/Link may apply its own buyer terms, refund rules, fraud controls and legal requirements to the transaction.

Your order is confirmed when Stripe reports successful payment to Resthe.

Gift codes. Resthe may issue free gift codes. A gift code can be used once, for one gift of any product, before the expiry date given when it is issued. A gift code may be passed on to another person, but it may not be sold, has no cash value and cannot be exchanged for money. When you use a gift code, no payment is taken: your order is confirmed when you submit it, and wherever these terms refer to the time of payment, that is the time you submit the order with the code. Section 9 (refunds and payment support) does not apply to free gifts.

7. Delivery

The gift is digital. After successful payment we make available a gift link for the recipient and a private management link for the purchaser, and we send the applicable order information to the purchaser’s checkout email address.

Keep the private management link confidential. If link recovery is offered, it is available only through the recovery method shown on the site.

Delivery is considered to begin when the digital gift page or management link is first made available after payment.

8. Cancellation, withdrawal and immediate digital delivery

Resthe gifts are personalized digital products/services intended to begin immediately after payment.

Where local law provides a mandatory cancellation or withdrawal right, that right remains available unless and to the extent it has been validly waived, lost or satisfied under the law that applies to the customer.

For customers in the European Economic Area or the United Kingdom: the gift page and certificate are digital content supplied immediately after payment. At checkout you expressly request immediate supply and acknowledge that you lose your right of withdrawal once supply has begun. We confirm this in the email you receive after payment. If this request was not validly given, your statutory withdrawal right applies.

Nothing in this section removes statutory rights for a product or service that is faulty, not supplied, or materially not as described.

9. Refunds and payment support

Our refund rules are described in the Refund Policy.

For orders processed through Stripe Managed Payments, Stripe/Link also handles transaction-level support and may process refunds under the Sold through Link rules or where required by law. Stripe’s Managed Payments refund rules may override a more restrictive Resthe refund rule for matters Stripe controls as merchant of record.

Questions about the gift itself can be sent to support@resthe.com. Questions about the payment, receipt or a Stripe/Link refund request may also be handled through Link support.

10. Your dedication and the registry

You are responsible for the names, message and other content you enter. Message lengths are set out in section 4. Content must not be unlawful, threatening, hateful, harassing, defamatory, fraudulent, obscene, or infringe another person’s rights.

You should only provide a recipient’s personal information where it is reasonable to expect that person would welcome receiving the gift or related notification.

We may refuse, hide or remove content that violates these rules or applicable law.

Where Resthe shows gifts in a public registry, a gift is hidden or displayed only in a privacy-preserving form as described on the site: no email addresses, no messages, and no exact coordinates of private places. Full names are not made public without the relevant person’s permission.

11. Availability, data sources and changes

We work to keep Resthe available and the rules applied consistently. External services, mapping systems, email providers and other data sources can have temporary outages or errors.

Where reasonably possible, Resthe will recover or reprocess missing information after a temporary outage. We may change, suspend or discontinue products for future orders. A completed order keeps the product-rule version stored with that order, subject to corrections required by law or to remedy an error.

12. Liability

Resthe is a commemorative digital service.

To the maximum extent permitted by applicable law, MTIRA LLC is not liable for indirect, incidental, special or consequential losses arising from a Resthe order, and MTIRA LLC’s aggregate liability relating to a particular order will not exceed the amount paid for that order.

This limitation does not apply where liability cannot lawfully be excluded or limited, including any mandatory consumer rights that apply in the customer’s jurisdiction.

13. Governing law

These terms are governed by the laws of the State of Florida, USA, without depriving a consumer of mandatory protections that apply under the law of the consumer’s country or place of residence.

14. Changes to these terms

We may update these terms for future orders. The version accepted for an order is stored with that order and continues to apply to it, except where a change is required by law or agreed with the customer.
